USCIS is clearly anticipating that this coming April 1, 2008 they will receive more than the 130,000+ H-1B Cap petitions they received last year. We hope that USCIS has made the necessary logistical improvements to handle this onslaught of H-1B filings better than last year, but only time will tell.
In what perhaps could be one such positive enhancement, USCIS has announced that effective January 30, 2008, the filing of all H-1B petitions for "exempt" employers will be centralized with the USCIS California Service Center. Under immigration law, H-1B petitions filed by certain types of educational, nonprofit and governmental organizations are not counted in the H-1B Cap.
Hopefully, by centralizing these exempt H-1B filings in one Service Center, USCIS personnel in the other three Service Centers will be able to better focus their efforts on the rush of April 1 H-1B Cap cases.
